Dead Rising Wins Lawsuit Against Dawn of the Dead

    The movie Dawn of the Dead and the video game Dead Rising have a few notable similarities: 1. Zombies are in a mall 2. You need to kill said zombies 3. Some horde of zombies is always in your grill, f*cking you up. MKR Group (on team Dawn of the Dead) was suing Capcom (team Dead Rising) for infringing on its copyrights (the whole dead people in a shopping center thing).

     

    US Magistrate Judge Richard Seeborg pwned the MKR Group's lawsuit; the judge agreed with Capcom's argument. The summary of the argument was that the similarities between the movie and the game were only the walking dead and the mall; and to be quite honest, you see that in a lot of places nowadays.

     

    If it were just left at that, I would understand it; but the strange part about this case was that the judge's convoluted reasoning.  One of the alleged complaints filed by MKR Group was that both the movie and the game were parodies of consumerism. The judge decided that the theme of Dead Rising was just to kill zombies in order to find the case of the infection and the social commentary from Dawn of the Dead was not present in the game.

     

     I'm glad that Capcom won because, c'mon MKR, if there is a zombie uprising there are limited places people think to go for shelter: the mall, a police station or a church. And I'm sure the companies behind Resident Evil and Night of the Living Dead wouldn't be bitching.
